By subscribing to MSBware.com, you agree to indemnify and hold harmless MSBware.com from any claims resulting from your use of this service which damages you or another party.

MSBware.com services may not be resold without the written consent of MSBware.com.

It is unacceptable, and unlawful in many areas, to send Unsolicited Bulk E-mail, also known as "SPAM". If SPAM is used to promote traffic to a site hosted by MSBware.com, that site is in violation of this policy and subject to immediate suspension, even if the SPAM originated outside of MSBware.com.

MSBware.com reserves the right to terminate any account being used to perform unacceptable or unlawful activities, as well as any account associated with unacceptable or unlawful activities.

MSBware.com does not make any express or implied warranty including, without limitation, implied warranties of merchantability and fitness for a particular purpose of any software or documentation. MSBware.com accepts no liability for lost or corrupted data, or software, or for other indirect, incidental, special or consequential damages.

Additionally, MSBware.com takes no responsibility for any damages suffered by you including, but not limited to, loss of data from delays, nondeliveries, misdeliveries, or service interruptions caused by MSBware.com own negligence or your errors and/or omissions. By using MSBware.com subscription services, you agree that under no circumstances will you hold or attempt to hold MSBware.com liable for any damages in excess of the total fees paid by you to MSBware.com in the previous six months.

MSBware.com does not make any express or implied warranty including, without limitation, implied warranties of merchantability and fitness for a particular purpose of any information, service or products offered on the Internet.

Although MSBware.com endeavors to make the Internet safe for its subscribers, MSBware.com accepts no liability for damages as a result of access to the Internet. Each subscriber is responsible for appropriate safety measures when interacting with the Internet including, but not limited to, scanning all downloaded files for viruses, guarding passwords, and protecting minors from inappropriate communication.

Although users can obtain information on standard safety measures from MSBware.com support personnel, MSBware.com in no way warranties, or accepts liability for such information.

MSBware.com. will make every effort to maintain the confidentiality of subscriber's electronic mail. However, because of technological limitations, MSBware.com cannot guarantee such confidentiality. Additionally, MSBware.com will cooperate with any law enforcement agency that has obtained proper legal authority to view subscriber's email.

You may cancel a month to month account at any time by letter. The Date of Termination will be the final day of the month in which you request the termination of your service. You will still be responsible for any fees incurred up to the Date of Termination of this service. Additionally, any fees collected in advance for future services are nonrefundable, even if the services are cancelled.

You may also cancel an account with a term contract at any time by letter. You will remain liable for recurring charges for the balance of the term outlined in the contract.

Credit card information may be used by MSBware.com only to fund charges authorized by you, and will only be used if entered by you for recurring charges.

MSBware.com Signature Service allows for the unlimited transfer data, unlimited email addresses, unlimited FTP access to your files, and unlimited processor time. MSBware.com reserves the right to suspend indefinately access to any files or directories which interrupt access to or performance of other clients' websites.

MSBware.com will take any steps it deems necessary to stop any process or activity which compromises the function of a MSBware.com server. These processes or activities may include intended or unintended acts of our members, and stopping these processes or activities may include disabling the account of the member whose processes or activities are compromising the function of a MSBware.com server.
